By accessing or using our mobile application and website (collectively, the "Services"), you unconditionally accept and agree to be bound by these Terms. For the purposes of these Terms, "Personal Data" refers to any information that can identify or relate to a specific individual, including what is commonly known as "personally identifiable information" under relevant data privacy regulations.

You must be at least 13 years old to use the Services. You agree to provide accurate information when creating an account and to keep your login credentials secure. You are responsible for all activity under your account.
Your Personal Data: You retain full ownership of the audio recordings, notes, and other Personal Data you create or upload. You grant us a limited, worldwide, non-exclusive license to access, process, and store your Personal Data solely as necessary to provide the Services to you.
No AI Training: We strictly prohibit the use of your Personal Data for training artificial intelligence models or conducting research, whether by us or our Service Providers.
Company Intellectual Property: Bananote, LLC owns all rights, title, and interest in the Services, including the software, design, trademarks, and usage data (excluding your Personal Data).
Speech Recognition: Certain features use Apple's speech recognition. When you use voice dictation or invoke Bananote through Siri or the Shortcuts app, your audio may be processed by Apple in accordance with Apple's Privacy Policy. Your use of these features constitutes consent to such processing.

To ensure quality for all users, we may impose limits on the amount of audio you can transcribe or process within a given period. We reserve the right to throttle or suspend accounts that exhibit abnormal or excessive usage patterns that strain our infrastructure.
We may terminate or suspend your access to the Services immediately, without prior notice, if you breach these Terms. You may terminate these Terms by deleting your account and discontinuing use of the Services.
As-Is Service: The Services are provided "as is" without warranties of any kind. We do not guarantee that the Services will be error-free or uninterrupted.
Limitation: To the maximum extent permitted by law, Bananote, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or in connection with your use of the Services.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
